Donald Trump’s $5 Million Gold Card Visa

Donald Trump announced his plans to replace the EB-5 visa with a $5 million Gold Card visa. The move taken by Donald Trump has raised concerns among Indians waiting for a green card.

US President Donald Trump on Tuesday announced his plans related to the EB-5 visa which has been active for the last 35 years for investors with a Plan of “gold card” visa which will be a path to citizenship for $5 million.

The move has raised concerns among Indian citizens waiting for a US green card.

what the Commerce Secretary said

Howard Lutnick who is Commerce Secretary said the Trump Gold Card will replace the EB-5 visa in two weeks.

The EB-5 was created by Congress in 1990 to boost foreign investment and is available to those who spend about $1 million on a company that employs at least 10 people.

Lutnick said the gold card — a green card, or permanent legal residency — would raise the price of entry for investors and eliminate the fraud and “bullshit” that he said characterized the EB-5 program. Like other green cards in the USA, it would also include a path to citizenship.

Donald Trump has not given any statement on job creation requirements. As EB-5 visas are limited, Donald Trump thought the federal government could sell around 10 million “gold cards” to reduce the deficit. He said it would be the game change.

What is a ‘Gold Card’ visa?  And How is it different from a green card?

Let us understand the difference between these two visas.

# EB-5 Visa (Current):

Required Investment: $800,000 – $1.05 million  $5 million

Job creation requirement: Must create 10 USA jobs

Path to citizenship: 5-7 years

Backlog for Indians: people are waiting from 7 to 10 years

Gold Card Visa (proposed)

Investment required: $5 million

Job creation requirement: No job creation requirement

Path to citizenship: Instant path

Backlog for Indians: No backlog (direct purchase)

How will the Gold Card affect Indians waiting for a Green Card?

For India’s richest, Trump’s Gold Card visa could be a game-changer – offering a much faster and simpler path to US residency than the EB-5 investor visa or the lengthy H-1B to Green Card process.

But there’s a catch – it comes at a hefty price tag of $5 million, far more than the $800K requirement of the current EB-5 visa. This means that only India’s super-rich can afford this shortcut to US residency.

Will Trump’s Gold Card replace the EB-5 investor visa program?

Yes, if Trump’s Gold Card visa becomes effective, it will replace the EB-5 investor visa program.

Can Indians who are currently on H-1B or EB-3/EB-2 visas apply for the Gold Card?

Yes, Indians currently on H-1B or EB-2/EB-3 visas can apply for Donald Trump’s proposed Gold Card visa – provided they can afford an investment of $5 million. This new visa, introduced as a replacement to the EB-5 investor program, offers a shortcut to US citizenship without the usual hassle of job creation or setting up a business.

What are the alternative options for Indians?

As a Gold Card visa may not be accessible because of high investment  to most Indians, here are some alternative options:

EB-5 visa (if available before the Gold Card is replaced)

Investment: $800,000 (in targeted employment sectors).

Advantages: Green card in 3-5 years (faster than EB-2/EB-3).

Disadvantages: Requires job creation, long wait if demand increases.

O-1 visa (for highly skilled individuals)

For professionals with exceptional abilities (arts, tech, business, research, ).

EB-1 Green Card can be obtained (with no backlog for Indians).

L-1 visa (for business owners and executives)

H-1B to EB-2/EB-3 (current skilled worker route)

For Indian tech workers in the US on H-1B visas.
